I was in the middle of my class today and got two SMSes and miss call from my friend. I only managed to check them during the break. It happened that some company from Johor wanted to sue a blogger from Kuching who is now residing in KL because of a blog post that the blogger made months back. I cannot reveal the details on who they are for the time being.
It happened that the blogger blogged about a shop in Kuching that has several branches around Kuching and throughout Malaysia(if not mistaken) asking people to beware of them because of scam. OK… I read that post before and I definitely agree with it because the blogger is not the only one thinks so, I think so too as I personally came across them also but never got scammed because I never bother, so does other people that I know and I also heard people talking about it everywhere asking friends to beware of this company. HEY! We are not 1 year old kid OK?!?! Scam or no scam we know very well ourselves. We are the consumers and we have the responsibility to report something or let people know when something’s not right. They want the blogger to remove the post because it tarnished their image and resulting in loss. If the blogger doesn’t want to remove, then they will file a lawsuit. The problem is that it’s a real encounter else there won’t be story about it.
OH PLEASEEE!! EXCUSE ME! If you are so much of doing a legal business, you surely won’t be using measures or ways that make the consumer feel uncomfortable about the trustworthiness of your company. You should use a “proper” way to do business instead the way you choose are more of the “scammer” way. Blame yourself for using such technique!
Why I know about it? That’s because we are providing the platform for blogging for that blogger. They want to sue us if we don’t provide details of the blogger to them and we have the right of not disclosing the details after consulting a lawyer. SO what!??! Want to sue us too? Saying that we didn’t monitor the things that we host. You might as well sue Streamyx also since Streamyx was the one providing the Internet access to allow the blogger to update. Also since we are reseller only, you might as well go sue the provider of the server that provides the server to us because the provider didn’t check on contents that are hosted in the server.
ONE WORD… STUPID! On the other hand, I think that blogger would be really famous if the identity is leaked hahaha… Did a search on the topic, the blogger listed No.1 in Google for it!! No wonder they want to sue π Hahaha… For now, that’s all I can let you know. So? Think twice before blogging? Or next time, better don’t be so direct?
I hope this issue will solve soon -.-” All the best to the blogger. What do you think of this? Should the post be removed since it’s a real thing that happened? Should the blogger fight on?
Update: The company said that they will give one week grace period. If nothing is done, they will take legal action. However, according to the lawyer that we had consulted, we were told to wait for the legal letter. Guess what?!?!? They even contacted Yahoo and Google to remove the listing. To laugh or to cry?!?! Hmm…
07-07-08: The post is removed but I don’t think this will be the end of the case yet. We’ll wait and see.
worry ler..me kinda worry
i won’t remove the post if it’s the truth. everyone has the right to know the truth and btw, the blog is the author’s. the author has every right to blog wadeva the author wants. There’s nothing the server or hoster can do. Not like they can control wad the author posts. The company should just face it. Scam or no scam.. It won’t be wad it is today if they know how to “service” properly. We as bloggers share with everyone wad we see and experience. NOTHING WRONG WITH THAT!
sharon, no need worry :p Hehehe… see how it progress, it can be another history in the blogsphere hehehe… Usually you see people sure political blogger, now this will be first non-political blogger issue.
annna, yealo… It’s the truth, why must remove, who ask them do such thing? Summore the blogger is not the only one talking about it in the net, I managed to find some other links that leads to it also in other forums, so they might as well sue those two forums also. Theirs aren’t as detail as the blogger’sbut the blogger was posting it based on experience and many comments were left saying that they are the victims also, so? Means it’s true. I heard that there are also people that file reports about that particular company to the authority. Besdies that, they are using the ways that the government blacklisted and it was reported in the newspapers that this kind of act are wrong. So so so? Obviously it’s a bad company. Now want to take legal action on the victim? Hahaha… It’s like slapping their ownselves.
Owh.. so, that’s the thing that jimmy wrote in his blog *LOL*
If me ah.. I won’t remove also lor. Sue sue lar.. Scare you ah.. I can always create another blog anytime I want if I were asked to close down the blog..
hi,
my friend working in cyber law said that this case is treated as Defamation Law.
which is “Any intentional false communication, either written or spoken, that harms a person’s reputation; decreases the respect, regard, or confidence in which a person is held; or induces disparaging, hostile, or disagreeable opinions or feelings against a person.
Defamation may be a criminal or civil charge. It encompasses both written statements, known as libel, and spoken statements, called slander.”
no matter is in written newspaper or blog…
in my opinion, i think better take the post down lar for less trouble…
maybe can put it somewhere else besides ur blog… *hint hint* ^^
paul, if they sue until court… tat blogger need go court… not 100% she can win.. but if she got alot of proofs… then can fight back.
paul, yealo… unless you have many strong evidents else just remove lo…
ahlost, we all hope no need to remove since it’s a fact but not enough evident also susah…
Wow… that sucks. I hate bullying of any kind and this company is literally stepping all over the blogger. Word of advice to the blogger: Copy everything, find someone in Israel and ask them to post for you. π
Or they can edit the post to make it sort of legally indirect, like jumbling up the company name but still very obvious to others.
But overall, I just feel sorry for the blogger.
Hm.. I support Irene though.. If there’s this kind of law, where’s our freedom of speech? o.O Everyone is really talking bad about another person or company everyday.. Thus, affecting that person’s or company’s reputation. So, izzit still applicable? π
elvawenn, yealo π Hahaha…
serene, what to do? sigh… If to fight on, it will cause a lot of money and energy sigh… Unless have very strong evident.
if u ppl wan to fight with tat company also can… go blog about them again. but make sure u got alot of proof.. so can shoot them back… wakkakaaa
Can.. Bloggers are one de.. When one blog about something and get picked on, surely other bloggers will help defend π all blog together, see who “pick” on who.. but 1st, will nd details o.. o.O lol
Must have proof, if not also cannot hahaha…
